Specific regulations - works on or affecting a proposed
European Site in Scotland and Wales, or Ramsar Site
In England candidate SACs are already European Sites as a matter of law. In
Scotland and Wales cSACs are not European Sites as a matter of law but it is
government policy to treat them and (as in England) proposed SPAs and classified
Ramsar Sites as if they are fully designated European Sites for the purposes
of considering development proposals that may affect them*.
* Note: Further guidance on this policy may be found in paras 13
and C7 DoE PPG9, 1994; DETR, Ramsar Sites in England A Policy Statement, 2000;
the footnote page 1 of Welsh Office TAN 5 Nature Conservation and Planning 1996;
and para 39 Scottish Executive Development Department NPPG14 Natural Heritage
1999.
